A federal judge has ruled the immediate release of Kilmar Abrego Garcia from immigration custody, finding his continued detainment lacks lawful basis.

"Since his return from wrongful imprisonment in El Salvador, he has been re-detained, again without legal justification," the judge wrote in her order.

The situation stems from a erroneous removal to El Salvador in March, which US authorities later acknowledged was an mistake. Following his repatriation to the United States to face alien smuggling charges, he was held in federal custody.

In her order, the court pointed out that the government lacks a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "for now."
